Self-employed people with dependents (TRADE) will be able to hire workers as employees. This is one of the measures approved in the Law 31/2015, of September 9 and will enter into force on 10 October of this year. In principle, TRADE cannot employ workers, or contract or subcontract part or all of their work to third parties. With the new amendment, TRADE will be able to hire a worker, to reconcile their professional activity and family life, in the following cases:

  • Risk during pregnancy.
  • Risk during breastfeeding of a baby under 9 months.
  • Period of maternity leave, paternity leave, adoption or pre-adoptive or permanent foster care leave.
  • Care of child under seven years who are in their charge.
  • Be responsible for a relative, by consanguinity or affinity, in a situation of dependency.
  • Be responsible for a relative, by consanguinity or affinity, with equal or greater than 33% disability.

Once the causes that led for the contract are completed, if another cause of those listed in the standard occurs again an employee can be re-hired, provided that more than 12 months has passed since the previous contract.
